CRITICALLY EXAMINING THE ARTHA RIN ADALAT AIN 2003

November 30, 2017

The Artha Rin Adalat Ain 2003 specifically regulates the loan recovery process that the financial institutions ought to follow when facing default or nonpayment from borrowers. However, certain provisions of this Act of 2003 have long been considered by some academics and practitioners alike to be considerably biased in favour of the lender financial institutions at the expense of borrowers and innocent third parties. As such, Bangladesh Institute of Law and International Affairs (BILIA) organized a symposium titled “Critically Examining the Artha Rin Adalat Ain” to address this perceived unfairness in the law.

RECENT JUDICIAL DECISIONS IN TORT LAW: A CHANGING TIME?

October 21, 2017

People in Bangladesh frequently suffer personal injury due to the negligence of others, be it pubic authority bodies or private parties, yet seeking compensation for such injury in tort remains extremely rare. As such BILIA decided to hold a symposium highlighting two recent tort cases in the Supreme Court of Bangladesh which ordered substantial sums of compensations to be paid to the claimants. The first is the infamous case of baby Zihad who died after falling into a 300 feet deep manhole which was left uncovered by WASA authortiies. The second case is the Appellate Division's recent order of 1.7 crore in damages against Bangladesh Beverage Industries (Pepsi Co), whose delivery driver struck and killed a pedestrian in Dhaka.
